Terms of Use

1. Acceptance of Terms

By accessing or using the Nourishin website, mobile application, or Village Directory, you agree to be bound by these Terms of Use. If you do not agree, please refrain from using our services.

Nourishin Pty Ltd (“Nourishin”, “we”, “us”, “our”) may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

2. Purpose of Platform

Nourishin is a digital platform designed to support families through pregnancy, postpartum, illness, loss, and beyond. It includes tools to coordinate care, share updates, access resources, and connect with local support providers through the Nourishin Village Directory.

Nourishin is not a healthcare provider, does not provide medical or health services, and does not refer or recommend any listed provider. Nothing on this platform constitutes medical, health, nutritional, psychological, or professional advice. Users should always seek independent professional advice suited to their circumstances.

3. Village Directory – Provider Listings and Subscriptions

3.1 Application and Approval

Submitting an Expression of Interest (EOI) does not guarantee inclusion in the directory. Listings are approved at the sole discretion of Nourishin based on the completeness and relevance of the information provided and alignment with our community values.

Nourishin may collect qualifications, insurance, registration status, or business practices of a provider but they do not verify the service. Any engagement between a user and a listed provider is undertaken independently and at the user’s own discretion.

3.2 Provider Representations and Warranties

By submitting a Village listing and at all times while your listing is active, you represent and warrant that:

  1. all information in your listing is true, accurate, complete, and not misleading;
  2. you hold all qualifications, licences, registrations, and insurances required by law to provide the services described;
  3. your listing content complies with all applicable Australian and New Zealand laws and regulations, including advertising obligations relevant to your profession;
  4. you will promptly update your listing if any information changes, including changes to registration status, services offered, qualifications, or contact details; and
  5. you have the right to grant Nourishin the licence described in clause 5 in respect of all content you submit.

3.3 Listing Content Standards

All listing content must be factual, accurate, and not misleading. Providers must not include:

  • Testimonials, reviews, or endorsements from clients, patients, or any third party
  • Statements about outcomes experienced by specific individuals
  • Claims implying guaranteed results or specific therapeutic outcomes
  • Any content that could constitute a prohibited representation under the Australian Consumer Law

This no-testimonials rule applies to all providers regardless of membership plan or professional category.

3.4 Advertising Obligations for Regulated Health Practitioners

If you are a health practitioner registered under the Health Practitioner Regulation National Law Act 2009 (National Law) – including any practitioner registered with the Australian Health Practitioner Regulation Agency (AHPRA) – the following applies.

You are solely and entirely responsible for ensuring that your listing, including all text, images, and any other content, complies with:

  • Section 133 of the National Law, which prohibits advertising of regulated health services that is false, misleading, or deceptive; creates unreasonable expectations of beneficial treatment; directly or indirectly encourages unnecessary or inappropriate use of health services; or uses testimonials
  • The current AHPRA Guidelines for Advertising a Regulated Health Service (available at ahpra.gov.au)
  • Any advertising standards or guidelines issued by your specific registration board

You acknowledge that:

  1. It is your responsibility – not Nourishin’s – to review your listing content against AHPRA’s current advertising guidelines before your listing goes live and each time content is updated;
  2. Nourishin does not provide legal, regulatory, or compliance advice and cannot assess whether your listing meets your professional obligations;
  3. Nourishin’s no-testimonials policy aligns with but is independent of AHPRA’s prohibition on testimonials – both apply to your listing; and
  4. A breach of the National Law advertising provisions is a matter between you, AHPRA, and your registration board – Nourishin bears no responsibility for your compliance or non-compliance.

3.5 Provider Indemnity

You agree to indemnify, defend, and hold harmless Nourishin Pty Ltd and its officers, employees, and agents from and against any claims, losses, damages, penalties, fines, or expenses (including reasonable legal costs) arising out of or in connection with:

  1. Any inaccuracy or misrepresentation in your listing content;
  2. Any breach by you of applicable advertising laws or regulations, including the National Law;
  3. Any breach of these Terms; or
  4. Any claim by a third party arising from your provision of services.

3.6 Listings Are Not Endorsements

Inclusion in the Nourishin Village Directory does not constitute an endorsement, recommendation, referral, or approval by Nourishin of any provider, their services, qualifications, or conduct. Families are encouraged to conduct their own research and exercise their own judgement when engaging any listed provider.

3.7 Nourishin’s Right to Review, Suspend, and Remove

Nourishin reserves the right at any time, in its sole discretion, to:

  • Decline any application to list in the Village Directory
  • Request amendments to listing content before approval or while a listing is active
  • Suspend or remove any listing immediately and without prior notice where Nourishin reasonably believes the content is inaccurate, misleading, in breach of these Terms, or inconsistent with Nourishin’s mission or values
  • Terminate a provider’s access to the platform for serious or repeated breaches of these Terms


Where a listing is removed for breach, Nourishin is not obligated to provide a refund of any subscription fees paid.

3.8 Subscription Terms

Directory listing access is provided on a subscription basis (monthly or annually). Payment is processed via secure third-party platforms (e.g. WooCommerce and Stripe). Subscriptions auto-renew unless cancelled before the renewal date. 

3.9 Cancellations and Refunds

Providers may cancel their subscription at any time through their account dashboard, or contacting support@nourishin.com.au at least 7 days prior to renewal for assistance.

Monthly subscriptions: Cancellation takes effect at the end of the current billing period. Access to paid features remains active until that date. If you joined on a Founding Member offer, cancellation forfeits that rate permanently. Re-subscription will be at the then-current standard pricing.

Annual subscriptions: Cancellation takes effect at the end of the 12-month billing period. No automatic pro-rata refunds are provided for unused time. Refund requests for exceptional circumstances may be submitted to support@nourishin.com.au and will be considered at Nourishin’s discretion.

Where a listing is suspended or removed by Nourishin for breach of these Terms, no refund will be provided.

3.10 Founding Member Offer Terms

  1. The Founding Member offer provides 3 months free on the first annual term, or 1 month free on the first monthly term, depending on the plan selected.
  2. After the initial discounted term, subscriptions renew automatically at standard rates unless cancelled before the renewal date.
  3. Cancellation during the discounted term forfeits the Founding Member rate permanently. Standard pricing applies on any future re-subscription.
  4. No pro-rata refunds are issued for unused time on either plan type.
  5. This offer is available for a limited time and may be withdrawn at Nourishin’s discretion.
  6. All other Terms of Use apply.

4. Families Using the Directory

Users browsing the Nourishin Village Directory acknowledge that:

  1. Directory listings are provided for information only and do not constitute a referral, recommendation, or endorsement by Nourishin;
  2. Nourishin does not verify the qualifications, registration, insurance, or conduct of listed providers;
  3. Any arrangement or transaction with a listed provider is solely between the user and that provider; and
  4. Nourishin accepts no liability arising from a user’s engagement with any listed provider.

5. Intellectual Property

All content created by Nourishin – including platform design, copy, branding, and editorial content – is owned by Nourishin Pty Ltd and protected by Australian intellectual property laws. You may not reproduce, distribute, or republish any Nourishin content without prior written permission.

By submitting content to a listing, you grant Nourishin a non-exclusive, royalty-free, worldwide licence to display, reproduce, and publish that content on the Nourishin platform for the purposes of operating the directory, for the duration your listing is active.

6. Website and App Content

All platform content is provided for informational purposes only. Nourishin does not guarantee that content is current, complete, or error-free, and may modify content at any time without notice.

7. User Conduct

You agree to use the Nourishin platform in a lawful and respectful manner. You must not:

  • Post offensive, harmful, or misleading content
  • Infringe the intellectual property or privacy rights of others
  • Share private address details beyond your intended recipients
  • Attempt to gain unauthorised access to any part of the platform or its systems

8. Third-Party Services and Links

The platform may contain links to third-party websites or services for convenience only. Nourishin is not responsible for the content, privacy practices, or conduct of third-party providers.

9. Privacy

We are committed to protecting your privacy. By using the Nourishin platform, you consent to the collection and use of your information as described in our Privacy Policy at nourishin.com.au/privacy-policy.

10. App Functionality and Availability

Nourishin may update, suspend, or discontinue any platform feature at its discretion. No guarantees are made regarding uninterrupted access or availability.

11. Disclaimer and Limitation of Liability

The Nourishin platform is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Nourishin excludes all liability for any direct, indirect, incidental, or consequential loss or damage arising from your use of the platform, your engagement with any listed provider, or any content accessed through the platform.

Where liability cannot be excluded under the Australian Consumer Law, Nourishin’s liability is limited to the cost of re-supplying the relevant service or, where applicable, the subscription fees paid by you in the 3 months preceding the claim.

12. Food Safety and Responsibility

The Nourishin platform facilitates coordination of meal support between families. Nourishin does not inspect, supervise, or take responsibility for food prepared or delivered by users.

  • Individuals preparing or delivering meals are solely responsible for food safety and hygiene standards
  • Recipients are responsible for communicating dietary requirements and assessing meals before consumption
  • Nourishin is not liable for any loss, illness, or injury arising from the preparation, delivery, or consumption of meals coordinated through the platform

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms are subject to the non-exclusive jurisdiction of the courts of New South Wales.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
